Recently, our firm prevailed in an invalidation proceeding for a utility model patent titled Drainage Device for Anti-floating of Underground Structures. The National Intellectual Property Administration (CNIPA) issued Examination Decision No. 630212, fully invalidating the patent (Patent No.: 201821860299.8).
In this case, the Licheng team efficiently completed technical analysis and evidence collation, and filed an invalidation request in accordance with the law. In response to the claims amended twice by the patentee, our team fully presented legal arguments during the oral hearing and precisely demonstrated the lack of inventiveness in the technical solutions of the patent in question.
CNIPA upheld our core contentions, finding that the claims of the challenged patent could be readily derived from prior art combined with common general knowledge, and thus failed to satisfy the inventiveness requirements under the Patent Law of the People's Republic of China. The patent was therefore fully invalidated, effectively protecting the legitimate rights and interests of our client.
Given the ongoing litigation related to this matter, the successful full invalidation has eliminated our client’s patent infringement risks and laid a solid preliminary foundation for the client’s stable business operation.
