Success Cases | Licheng Assists Client in Fully Invalidating Litigated Patents and Resolving Infringement Crisis
Recently, Licheng Intellectual Property has added another successful case. Our company represented Jiangsu Shuangyou in filing an invalidation request against the invention patent Method and Apparatus for Continuous or Semi-continuous Casting of Metals (Patent No.: 200480018604.3) owned by Knowles Head Company, and finally obtained the official decision from the National Intellectual Property Administration (CNIPA), which declared the patent right fully invalid.
Jiangsu Shuangyou was involved in a patent infringement lawsuit initiated by Knowles Head Company, and faced the risk of being found infringing and bearing corresponding compensation liabilities in the first instance.
After being entrusted, the Licheng team immediately started case analysis, accurately identified the core defects of the involved patent, and took "lack of inventiveness as stipulated in Paragraph 3, Article 22 of the Patent Law" as the key breakthrough. The team systematically integrated patent documents from multiple countries including Europe, the United Kingdom, the United States, and Canada, as well as relevant common general knowledge materials, constructed a complete and rigorous evidence chain, and then formally filed an invalidation request with the CNIPA.
After a comprehensive review by the CNIPA, Examination Decision No. 587932 was finally issued. It was determined that Claims 1-4 of the involved patent all lack inventiveness, the patent right was declared fully invalid, which fundamentally dismantled the legal basis of the infringement accusation.
